Harry V. Jaffa (1918-2015), professor at Claremont McKenna College and Distinguished Fellow of the Claremont Institute, was one of the most influential thinkers of the 20th century. His hundreds of students have reached positions of power and prestige throughout the intellectual and political world, including the Supreme Court and the Trump White House. Jaffa authored Barry Goldwater's famous 1964 Republican Convention speech which declared, "Extremism in the defense of liberty is no vice. And moderation in the pursuit of justice (...) is no virtue." William F. Buckley, Jaffa's close friend and a key figure in shaping the modern conservative movement, wrote, "If you think it is hard arguing with Harry Jaffa, try agreeing with him." His widely acclaimed book Crisis of the House Divided: An Interpretation of the Issues in the Lincoln-Douglas Debates (1959), was the first scholarly work to treat Abraham Lincoln as a serious philosophic thinker. As the earliest protégé of the controversial scholar Leo Strauss, Jaffa turned his theoretical insights to understanding the United States as the "best regime" in principle. He saw the American Revolution and the Civil War as world-historical events that revealed the true nature of politics. Statesmanship, constitutional government, and the virtues of republican citizenship are keys to unlocking the most important truths of political philosophy. Jaffa's student, Glenn Ellmers, was given complete access to Jaffa's private papers at Hillsdale College to produce the first comprehensive examination of his teacher's vast body of work. The aim of Massimiliano Tomba’s Insurgent Universality is to return to Marxism’s original historical vocation by freeing it from the hegemony of the exchange system and the encompassing agency of value. At the heart of this project appears the recognition that time, space and thus history have been captured by capitalism and transformed into categories of its own to organise people and social relationships for capital’s programme of accumulation. In this way, capital has been able to hijack history and invert (...) it into a representation of the real, into a historical trompe-l’œil instead of ‘presentify(ing) the past’. In this regard contemporising the past is an act of intervening in history and actualising it rather than representing it. Through this operation Tomba is able to retrieve an inventory of repressed and forgotten histories, which will unveil the sources of an ‘alternate legacy of modernity’ and radical political possibilities for the present. According to the interest theory of rights, the primary function of rights is the protection of fundamental interests. Since children undeniably have fundamental interests that merit protection, it is perfectly sensible to attribute rights, especially welfare rights, to them. The interest theory need not be hostile to the accommodation of rights that protect agency because, at least in the case of adults, there is a strong connection between the protection of agency and the promotion of welfare. Children have welfare rights (...) similar to those of adults. But children lack the agency rights adults have because children initially lack and only gradually develop the kinds of capacities for agency that are necessary for agency rights. One of the central pillars of Vygotsky’s contribution to social science is his concept of mediation: the process through which the social and the individual mutually shape each other. His rich, complex and challenging texts focus on a nuanced notion of mediation that was not necessarily visible to those active in the command-and-control climate of the Stalinist era. The article focuses on this notion of the lack of visibility in mediation.

This paper repudiates Manuel Vargas’s attempt to supplant the traditional moral influence theory of responsibility with his ‘agency cultivation model’. By focusing on fostering responsiveness to moral considerations, ACM purports to avoid the chief pitfalls of MIT. However, I contend that ACM is far less distinctive than it initially appears and so possesses all of MIT’s defects. I also assail Vargas’s counterfactual test for assessing whether a wrongdoer can respond to moral considerations. It is argued that the counterfactual test is (...) epistemically redundant because it can only be fleshed out once we have settled the issues it is supposed to resolve. Moreover, it tacitly inverts the relation between freedom and responsibility—we cannot attribute free will to wrongdoers unless we have already established their blameworthiness. The upshot of this is that enquiries into an agent’s freedom are irrelevant to the ethics of holding her responsible. (shrink)
